1. Who we are

These terms and conditions apply to the online shop TCGSecret, operated by:

In these terms, “we” and “us” means TCGSecret and “you” means the customer.

2. Definitions

  • Consumer: a natural person who is not acting for purposes related to their trade, business, craft or profession.
  • Business customer: a customer acting in the course of a trade, business or profession.
  • Withdrawal period: the period of 14 days in which a consumer can cancel a purchase without giving a reason.
  • Pre-order: an order for a product that has not yet been released or is not yet in stock, with an expected release or delivery date stated on the product page.
  • Sealed product: a product in the original, unopened manufacturer packaging (for example booster boxes, booster packs, elite trainer boxes and bundles).

3. Applicability

These terms apply to every offer we make and every order placed through our website. They are available on this page before you place an order and can be saved or printed. If you are a consumer, nothing in these terms limits the rights you have under mandatory consumer law of the Netherlands or of the EU country where you live.

4. Our offer and product information

  • We describe our products as accurately and completely as possible. Product photos are representative; packaging artwork can differ slightly between print runs.
  • All products we sell are official products sourced from the manufacturer, official distributors or trusted suppliers.
  • Offers are valid while stock lasts. Stock shown on the website is updated regularly but may occasionally be incorrect.
  • Obvious errors or mistakes in an offer, such as a clearly wrong price, do not bind us. If this happens after you have ordered, we will contact you and you may choose to cancel with a full refund.

5. How the contract is formed

  • The contract is formed when you complete your order and we confirm receipt of your order by email.
  • We may refuse or cancel an order for a legitimate reason, for example when the product turns out to be unavailable, the price was an obvious error, a purchase limit is exceeded, or we have reasonable grounds to suspect fraud. If we cancel, we will tell you as soon as possible and refund any amount paid within 14 days.

6. Prices and payment

  • All prices are in euros and include Dutch VAT (BTW). Shipping costs are shown separately before you confirm your order.
  • You can pay using the payment methods shown at checkout (iDEAL and credit card). Payments are processed by Stripe Payments Europe, Ltd.
  • For consumers: these terms cannot oblige you to pay more than 50% in advance. If you choose to pay the full amount at checkout, you keep all your rights under these terms and the law.
  • We may change prices at any time, but a price change never affects an order that has already been confirmed.

7. Pre-orders

  • The expected release or delivery date for a pre-order is shown on the product page. These dates are set by the manufacturer or distributor and may change.
  • If the release date is postponed, we will inform you by email. You may then cancel your pre-order free of charge and receive a full refund.
  • Manufacturers sometimes reduce the quantities allocated to retailers. If we receive fewer units than ordered, pre-orders are fulfilled in the order in which they were placed. If we cannot deliver your pre-order in full, we will contact you, deliver what we can if you agree, and refund the rest within 14 days.
  • You may cancel a pre-order free of charge at any time before it has been shipped. After delivery, your normal right of withdrawal (article 10) applies.

8. Purchase limits

To give as many collectors as possible a fair chance, we may set a maximum quantity per customer or per household for certain products. Any limit is shown on the product page. Orders that exceed a limit may be reduced to the maximum quantity or cancelled; any amount paid for items we do not deliver is refunded within 14 days.

9. Delivery

  • We ship to the Netherlands and Belgium with PostNL. Shipping costs, delivery times and how we ship pre-orders are explained on our Shipping page. Delivery times shown on the website are indications.
  • In-stock orders are delivered within 30 days at the latest, unless a different delivery date has been agreed (for example for pre-orders). If we cannot deliver on time, we will tell you and you may cancel free of charge with a full refund.
  • For consumers, the risk of loss of or damage to products stays with us until the products have been delivered to you or to a person you have designated.
  • Please check your parcel on delivery and let us know as soon as possible if the packaging or products are damaged, preferably with photos.

10. Right of withdrawal (returns)

As a consumer you can cancel your purchase within 14 days without giving a reason. The full procedure and the model withdrawal form are on our Returns & Withdrawal page. In short:

  • The withdrawal period starts the day after you (or someone you designated) receive the product. If one order is delivered in several parts, it starts the day after you receive the last part.
  • You can withdraw via the withdrawal function on our website, by email to info@tcgsecret.nl, or by using the model withdrawal form.
  • You must return the product within 14 days after notifying us.
  • The cost of returning the product is paid by you.
  • We refund all payments received from you, including the standard delivery costs, within 14 days after receiving your withdrawal. We use the same payment method you used, unless you agree otherwise. We may wait with the refund until we have received the product back or you have shown proof of return shipment, whichever is earlier.
  • You may handle a product only as far as needed to determine its nature, characteristics and functioning — the same way you could in a shop. Sealed trading card products cannot be inspected in a shop by opening the factory seal or packs. If you open the factory seal, open packs or otherwise handle the product beyond what is necessary, you remain entitled to withdraw, but you are liable for the resulting loss in value, which we may deduct from the refund.
  • The right of withdrawal does not apply to products made to your specifications, such as custom bundles put together at your request.

11. Conformity and guarantee

  • We guarantee that our products meet the contract, the specifications stated in the offer, and reasonable requirements of soundness and usability. This legal guarantee cannot be limited by these terms.
  • If a product is defective or not as described, please report this within a reasonable time after you discover it. A report within two months of discovery is always on time.
  • Depending on the situation, we will repair, replace or refund the product, or offer a price reduction, in line with your statutory rights.

12. Complaints and disputes

  • Complaints can be sent to info@tcgsecret.nl with a clear description and your order number. We confirm receipt and respond in substance within 14 days. If a complaint needs more time, we will tell you when you can expect an answer.
  • If we cannot resolve your complaint together, you can submit the dispute to the competent court. Consumers living in another EU country can also get free help from the European Consumer Centre (ECC) in their country.

13. Liability

Our liability for damage resulting from an order is limited to the amount paid for that order, except in the case of intent or gross negligence on our part. This limitation does not apply where mandatory law does not allow it, and it does not affect your statutory rights as a consumer.

14. Force majeure

We are not liable for failing to perform an obligation because of circumstances beyond our reasonable control, such as manufacturer delays or cancellations, carrier disruptions, strikes or natural disasters. In such cases we will inform you as soon as possible, and you may cancel the affected order and receive a full refund of any amount paid.

15. Privacy

We process your personal data in line with the General Data Protection Regulation (GDPR). How we do this is explained in our Privacy Policy.

16. Changes to these terms

We may update these terms. Changes do not apply to orders that were confirmed before the change. The version that applies to your order is the version available on our website when you placed it.

17. Applicable law and competent court

These terms and every contract with us are governed by Dutch law. If you are a consumer living in another EU country, you also keep the protection of the mandatory consumer law of your country of residence. Disputes are submitted to the competent Dutch court; as a consumer you may also bring a claim before the court of the place where you live.
